Florida Man Sues Wynn Las Vegas Over Legionnaires' Case

A Florida man has sued Wynn Las Vegas after allegedly contracting Legionnaires' disease during a January stay. Ruben Feliciano filed the negligence complaint Aug. 25 in Clark County District Court. Feliciano claims he fell ill while staying at Wynn from Jan. 12 to Jan. 15. He says he was later hospitalized in Florida from Jan. 22 to Jan. 25. Feliciano says he then received a letter warning he may have been exposed to Legionella at the property. He is seeking more than $30,000 in damages. Wynn Resorts declined to comment on the pending litigation.

Complaint Details Water Failures and Wynn's Silence

Feliciano's complaint alleges Wynn failed to clean, maintain, and monitor its water systems. It also claims the resort failed to warn guests about a hazardous condition on the property. According to the filing, Feliciano suffered "serious and permanent injuries" limiting his work and recreation.

Wynn Resorts spokesperson Ryan Jelniker declined to comment, citing company policy on pending litigation. "We do not comment on matters that are the subject of pending or active litigation," Jelniker said. Attorneys representing Feliciano did not respond to requests for comment.

Health District Investigation Found Legionella at Wynn

The lawsuit references a Southern Nevada Health District investigation opened in April. SNHD said it was investigating two travel-associated Legionnaires' cases tied to Wynn stays in September 2025 and February 2026. Both patients recovered, the health district said in a news release.

Environmental sampling at the resort turned up Legionella bacteria in multiple locations.

Wynn then began "immediate and comprehensive water system remediation measures," according to the health district.

Follow-up samples showed no detectable Legionella in the affected areas. The health district said Wynn cooperated with the investigation and directly notified guests about potential exposure. SNHD urged anyone who stayed at Wynn on or after Sept. 1, 2025, to complete a confidential health survey.

Legionnaires' Risks and Unanswered Questions in the Case

Legionnaires' disease is a severe form of pneumonia caused by inhaling water droplets containing Legionella bacteria. The CDC says people over 50 and current or former smokers face higher infection risk. Symptoms can include cough, fever, muscle aches, and shortness of breath. SNHD spokesperson Jennifer Sizemore said the agency could not confirm whether Feliciano was exposed at Wynn. "We can't comment on the lawsuit," Sizemore said, citing privacy rules around identifiable individuals. It remains unclear whether Feliciano's case overlaps with the February case SNHD previously disclosed. The lawsuit is pending in Clark County District Court, with no trial date yet set.
