South Dakota Gambling Guide 2026: Legal Status & Top Sweeps Sites

The Mount Rushmore State continues to reject proposals to legalize real-money online casinos, but it does allow land-based casinos and in-person sports betting. The first is the state’s historic Deadwood area, which is home to the vast majority of its in-person casinos. Lawmakers paved the way for legal gambling to return to the area in the late 1980’s, legalizing both commercial and tribal casinos. They have resisted calls to expand the industry to include online betting, believing it would threaten attendance at the state’s brick-and-mortar locations.

The second factor working against South Dakota online casinos is the state’s tribal gaming compact. To legalize online betting, the tribes would need to renegotiate the compact thanks to the Indian Gaming Regulatory Act of 1988. While this could bring a massive revenue spike, many tribes fear that commercial operators would dominate the market, ultimately leading them to lose money.

The final hurdle is the same one all states are facing: problem gambling. The spike in gambling addiction has been linked to the legalization of online betting. Lawmakers all over the country are working hard to fight the growing issue, but have had little success. That gives South Dakota lawmakers even more reason to reject gambling expansion, and is unlikely to change anytime soon.

All of these factors are combining to keep real money online casinos in South Dakota illegal.
