A federal lawsuit has been filed against a social media executive with ties to President Donald Trump and an affinity for expensive gambling endeavors.

X Strategies submitted its complaint against Derek Utley, the company’s co-founder, former chairman, and CFO, who is accused of embezzling at least $5 million to fund his lavish lifestyle and gambling activity. The lawsuit accused him of wagering money on more than 200 separate days in 2025.  

Utley denied wrongdoing and said the court process would settle the situation.

X Strategies is a political and corporate consulting firm based in Palm Beach. It helps manage numerous leading conservative social media accounts, including the Trump War Room and Team Trump accounts on X, as well as Trump’s TikTok presence, per POLITICO.

The 34-page lawsuit against the company’s co-founder was submitted last Friday. According to its material, Utley won $26 million while gambling on slot machines, but risked approximately $29 million for a net $3 million loss. This all occurred at what was determined to be the Seminole Hard Rock Hotel & Casino Hollywood.

Utley is also accused of purchasing luxury sports cars, designer clothes, and multiple vacations and renting “opulent condominiums,” all of which were “funded by money he embezzled from X Strategies.”

An audit of the company’s finances allegedly showed large casino withdrawals and unexplained payments to Utley and his other businesses. X Strategies said that it had multiple banks close company accounts because of suspicious transactions.

The analysis also found at least $5 million that X Strategies claimed was embezzled, meaning the money was illegally taken and misused by an individual who was trusted with access to its account.

Utley exposed for misusing funds

X Strategies asserts that Utley had sole control of its banking and financial records while he worked as company chairman and CFO. That allowed him to keep his financial activity in the dark without sounding any alarm bells. 

The lawsuit claims that Utley began using company money illegally in 2021. He attempted to make personal purchases appear as if they were related to business and would transfer money to other organizations he owned. He would also mix X Strategies' money with funds in his casino accounts.

Additionally, Utley is said to have labeled withdrawals of company money from casino ATMs as client entertainment expenses. He would gamble with that cash and then deposit the remaining funds, whether he finished the day up or down, in his personal accounts.

“X Strategies took all the risk—Utley got all the reward,” the lawsuit reads.

The scheme was exposed after Michael Seifert took over as the company’s president in 2026. Seifert allegedly noticed the company’s cash storage did not appear aligned with its revenue and spending.

An incident in Las Vegas also cast Utley in a negative light. According to the lawsuit, Utley requested an immediate and large cash transfer from a casino to help pay a large loss. The transfer was stopped, but it alerted Seifert to investigate previous withdrawals that were found to be unrelated to company business.

The lawsuit accuses Utley and other defendants of civil theft, breach of fiduciary duty, fraudulent misrepresentation, and RICO violations. It seeks damages beyond $5 million and could pursue treble damages, as well as a constructive trust over assets that were purchased with company money.
