Key Takeaways

  • The Seminole Tribe filed a 72-page lawsuit against DraftKings, CEO Jason Robbins, and GUS III LLC in Florida
  • The tribe alleges DraftKings Predictions and DFS offerings violate its exclusive sports betting rights in Florida
  • - The lawsuit seeks an injunction, revenue and profits earned in Florida, and includes a civil racketeering claim against Robbins

The Seminole Tribe of Florida has filed a lawsuit against DraftKings, alleging that DraftKings' prediction market and DFS offerings violate the tribe's exclusive rights to sports betting in the Sunshine State.

The complaint from the tribe is 72 pages and was filed Thursday in Broward County Circuit Court. The documents name DraftKings CEO Jason Robbins and GUS III LLC. GUS III LLC operates as DraftKings Predictions.

It also includes a civil racketeering claim against Robbins and is seeking two things: an injunction blocking DraftKings' offerings and all revenue and profits earned in Florida.

Under Florida law, the Seminole Tribe holds exclusive rights to sports betting and operates Hard Rock Bet.

This also comes as Massachusetts is looking into DraftKings over its alleged use of AI in sports betting, and Michigan is, too. At the same time, it didn't name DraftKings specifically but raised concerns about the report that did.

Seminole Tribe Argues DraftKings Predictions Operates Like Sports Betting

The Seminole Tribe alleges that people in Florida can place moneyline, point spread, totals, and other wagers through the DraftKings Sports & Casino app, and that the interface is almost identical to its licensed sports betting app in other states.

“That DraftKings Predictions may run in the background does not transform sports wagers into ‘commodities trading,’” the complaint reads.

The tribe also notes that, on Aug. 28, DraftKings changed the pricing that appeared on the prediction market platform. It used to show American betting odds, but changed to contract prices. This followed an early August directive from the Commodity Futures Trading Commission warning prediction markets against using sportsbook-like odds.

“DraftKings changed the label on the price. It did not change the price, the product, or the transaction,” the tribe argued.

In Florida, the minimum betting age is 21, but at DraftKings Predictions, players can make trades at 18. The tribe is singling out Robbins, who allegedly has 89% voting power at DraftKings.

DraftKings launched its prediction market platform in December 2025 and expanded to states like Florida, Texas, and California, where traditional online sports betting is illegal.

DraftKings also launched Pick6 in January and is now in Florida. It's part of the Sports & Casino app, and has been since June.

Lawsuit Highlights DraftKings' Previous Challenges to Florida Sports Betting Exclusivity

For more backstory, DraftKings contributed $22.7 million to a campaign in Florida in November 2022 to open the sports betting landscape to commercial operators, but it failed to qualify. The complaint also suggested that DraftKings secretly financed a lawsuit challenging the tribes' exclusivity, specifically one brought by West Flagler Associates. That mattered because it succeeded in 2021 but was overturned in June 2023.

The tribe also mentions that DraftKings was part of Protect the Constitution LLC, which challenged the compact in 2025.
