Nebraska Petitions Supporting Online Betting Submitted

Online sports betting may be on the verge of becoming a reality in the Cornhusker State.

The Tax Relief Nebraska (TRN), led by WarHorse Casino, has submitted the required signatures for two petitions to legalize online betting. The first proposes putting the issue on the November ballot and has received over 200,000 signatures. 

The second petition proposes a legal framework for the industry, which 146,000 Nebraskans signed off on.

Both petitions have been submitted to the Nebraska Secretary of State, whose office will review and verify the signatures. If approved, voters would decide on legalizing online betting during the midterm elections this fall.

WarHorse Warned Lawmakers in 2025

While the tribes were patient with Nebraska lawmakers over the last few years regarding sports betting, that patience began to wear thin. 

Over the last year, Nebraska and the rest of the US have felt the impact of sports prediction markets. These platforms aren’t subject to state gambling laws, but allow residents a legal option for online sports betting. This led tribes to step up their pressure on state lawmakers, fearing the new industry’s head start.

Despite the warning, the proposals didn’t have enough support among Nebraska lawmakers. That led to the creation of TRN earlier this year, which began the effort to put online sports betting on the ballot this fall.

Effort Circumvents State Legislature

By creating a constitutional amendment, TRN can circumvent Nebraska’s legislative deadlock and take the decision directly to voters. This not only provides an easier path to legalization but also allows the group to determine the industry's legal framework. As a result, they can create an operator- and tribal-friendly market, maximizing potential profits.

We saw a similar effort find success in Missouri in 2024. The state’s pro sports teams partnered with commercial operators to gather signatures to put legal sports betting on the ballot. Voters narrowly approved the measure during the November election, leading the market to launch late last year.

Missouri’s market is one of the most industry-friendly in the US, resulting in more profits for operators and less tax revenue for the state.

Success Far From Guranteed

The two petitions from TRN easily met the required threshold to be on the ballot, but that doesn’t mean online sports betting is inevitable. 

Nebraska’s potential vote will present a unique case study on where the public stands on online sports betting. We saw Missouri’s 2024 vote show that public support for the industry isn’t what it used to be. Fears over problem gambling and the industry’s impact on society have grown among Americans, with the industry offering few solutions.

However, Nebraskans will be the first group to vote on online sports betting since the emergence of sports prediction markets. These platforms allow residents to bet on sports, but do not contribute to the state’s tax revenue. That brings the dangers of betting to the state, but without any of the benefits. 

As a result, it's hard to predict how voters will respond to the proposal to legalize online sports betting.
