Key Takeaways

  • Underdog claims the AG did not give enough notice of his plan to go public
  • The opinion was scheduled to be released on Thursday
  • California is also considering a ban on sweepstakes casinos

Underdog Fantasy is fighting for its life in California.

The daily fantasy sports giant has filed a lawsuit in the Sacramento Superior Court, requesting that the court prevent Attorney General Rob Bonta from issuing a public statement on the legality of the industry. The suit claims that the state only provided three days' notice of the opinion, limiting the time for the operator to prepare for the expected fallout.

Bonta has stated that he plans to release the opinion on Thursday, July 3.

AG Opinion Could Deal Massive Blow

While the Attorney General’s opinion won’t change California’s laws on DFS, Underdog believes the fallout could be devastating.

One fear is that customers will decide to close their accounts once they hear the opinion. While the operators like Underdog wouldn’t be banned, it would lead people to worry about the dangers of the industry. The operator believes the AG’s opinion will mislead those people, causing irreversible damage.

Another key concern is how banks and business partners would respond. It could lead to operators like Underdog struggling to secure loans and sponsorships, resulting in a significant reduction in their revenue.

State Cracking Down on Gambling

Underdog and the DFS industry aren’t the only ones being targeted by California lawmakers. The Assembly is currently considering AB 831, which would place a ban on sweepstakes operators. These platforms offer sports betting and casino games, but without requiring real-money bets. This allows operators to circumvent sports betting regulations and the associated heavy taxes.

The bill was proposed soon after New Jersey passed their own ban. This continues to be a growing trend of states that are choosing to reject sweepstakes operators instead of regulating the industry.

Could Push Help Legalize Sports Betting?

While California lawmakers and leaders have cited the dangers that DFS and sweepstakes platforms can pose, there may be an ulterior motive behind the latest push to ban these industries.

California remains one of the few states that doesn’t offer legal sports betting. Negotiations between lawmakers, tribal leaders, and commercial business owners have not gone well. As a result, the tribes have spent millions to defeat each sports betting bill proposed in the state.

One reason for tribal resistance is their monopoly on casino gambling in California, which generates more revenue than Las Vegas. By eliminating sweepstakes and DFS operators, the state ensures that anyone wanting to gamble must visit a tribal casino. That should increase their revenue and may help strengthen the relationship between the state and tribal leaders.
