Kalshi is once again showing that it doesn’t care whether you believe it's gambling.

The prediction market operator’s recent filing with the US Patent and Trademark Office required it to disclose the industries in which it’s involved. While most of Kalshi’s responses involved sectors of the financial industry, it also included sports betting. This contradicts the legal and public arguments it has been making over the last two years, leading to the normally mundane action making national headlines.

A spokesperson for the operator described the filing as an attempt to “cast a wide net,” and not a confirmation that they are offering gambling.

Filing Makes No Qualms About Sports Betting

Representatives from Kalshi haven’t bothered to deny the trademark filing’s intent, given the clear language used. It clearly defines the sports betting services it provides, and even includes other gambling tournaments.

If the USPTO accepts the above industry classification, it will be confirming that it views Kalshi’s sports markets as a form of gambling.

Kalshi Downplays Filing’s Significance

While Kalshi’s reputation quickly drew national attention to the story, the operator didn’t hesitate to offer a clear defense. Kalshi spokesperson Elisabeth Dianna shared the following statement, assuring they remain confident that their markets do not qualify as gambling.

Our trademark strategy is intentionally broad and designed to cast a wide net, not to define our business. This is particularly important as companies in adjacent categories look to expand into prediction markets. A broader filing allows us to meaningfully protect the space and ensure that key terms are not used in ways that could blur distinctions between different products. This is not a characterization of our business as anything other than prediction markets.

Does Filing Show Cracks in Kalshi’s Confidence

While it has toned down its rhetoric over the last few months, Kalshi has previously advertised itself as a sports betting site while arguing to the contrary in lawsuits. That has led some to assume their recent filing is a resurgence of the operator’s past arrogance, but another factor could be at play.

The sports prediction industry has thrived, despite a wave of lawsuits and bipartisan opposition across the US. The reason for that success is support from the White House, but those allies may not have the power to project the industry much longer. That means the days of Kalshi avoiding the designation as a gambling platform would soon be over.
